Federal Judge Orders Release of Abrego Garcia from ICE Detention
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment lacks legal authority.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without legal justification," the judge stated in her ruling.
The situation stems from a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an mistake. After his repatriation to the United States to answer alien smuggling allegations, he was detained in immigration custody.
In her order, the court noted that the authorities lacks a current removal order, which prevents them from removing Mr. Abrego Garcia "for now."
Background of the Legal Challenge
The court proceedings center on disputed assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.
He has also pleaded not guilty to the smuggling charges, which are part of a separate trial in Tennessee.
Terms of Freedom
The court, who was hearing his challenge to deportation in a Maryland district court, determined that he must now adhere to the terms of his release from custody in Tennessee. This order shifts his supervision to the jurisdiction handling his criminal case.
This decision marks a notable turn in a complicated legal battle featuring allegations of wrongful detention and disputed criminal affiliations.
