Michael Jordan Tells Court He Felt No Fear of Nascar in Legal Battle

Michael Jeffrey Jordan, as he cordially introduced himself in a Charlotte court on Friday, stated that his drive to win and status as a newcomer motivated his effort with 23XI Racing to confront Nascar over alleged violations of competition laws.

Financial Stakes and a Competitive Drive

The owner disclosed financial and corporate details of his racing venture, revealing he put in $40m of his own funds into the Cup Series operation launched with partner Polk and driver Hamlin.

“It fell to someone to act,” Jordan said in the Charlotte courtroom. “As a newcomer, I wasn’t afraid. I believed I could take on Nascar as a whole. I felt as far as the sport required examination through a new lens.”

Central Issue: Charter Agreements and Contract Pressure

The heart of the case involves the expiration of a 2016 deal where Nascar granted each team a franchise. This system mirrors other professional sports with independent franchises, like the Charlotte Hornets or the Carolina Panthers. This deal was set to expire in 2024 when Nascar demanded charter membership renewals.

Jordan was on the witness stand for about sixty minutes and left the court to a media frenzy, with onlookers and reporters clamoring for a glimpse or a picture of the global icon.

Leading the Legal Charge

Jordan’s 23XI is leading the full-court press along with another racing team for Nascar to change a business model Jordan contended is breaking the law to keep two hands on the wheel.

For Jordan and and Heather Gibbs, who testified before Jordan, are events from September 2024. Gibbs described a hectic and tense six hours where the sanctioning body informed teams they must sign a contract extension. The document consists of 112 pages detailing team compensation and a guaranteed entry in every race.

Choosing Litigation

Jordan said that 23XI and Front Row Motorsports concluded their only feasible option was to decline to sign that extensive document and litigate the matter. The other 13 organizations signed the agreement.

Jordan and co-owner Denny Hamlin approached Nascar about potential amendments or negotiations. Nascar wasn’t talking, according to his testimony.

The Ultimate Motivation: Winning

But in the end, the pushback against what he saw as a unsustainable system was mostly about the usual bottom line for Jordan: Success.

“Denny convinced me adding a third car boosted our odds of winning,” he testified, noting that he purchased another franchise last year for $28m despite the uncertainty. “So I dove in.”

Account from the Gibbs Family

Heather Gibbs detailed her push for indefinite franchises, submitted in a formal letter to Nascar. She testified the timing of the signature deadline was problematic.

She said, the team founder first attempted to call and persuade Nascar against forcing signatures, but CEO Jim France refused the appeal.

“Please don’t force this on us,” Gibbs recounted was the message to Nascar’s leadership. The response was, “Whether I have 20 charters, that’s what I have. If I have 30, I have 30.”
